This post will discuss a custody concern that comes up often in Minnesota custody cases. Many parents contact our firm because the other parent is contemplating moving a long distance away either within the state or out-of-state. The parent who is not moving is concerned about custody and parenting time issues with the children. In the case of a parent moving out-of-state and wanting to take a child, Minnesota law is very clear that such a move is not permissible unless the moving parent has permission of the other parent or a court order.

CNN posted an article in October of 2009 that raised the question about what a parent can do to prevent child abduction. According to the article, Christopher Savoie, an American father, was granted full custody of his children by a Tennessee Court after learning that they were removed to Japan without his consent by their mother. He went to Japan to retrieve the children and was put in jail for his attempt to abduct his own children.
Read more...In Forma Pauperis is a latin term that means "in the character or manner of a pauper, poor person, destitute, or without means". If a party does not have the income to pay for filing fees or other court costs in a case, the Court can grant the person In Forma Pauperis status. If this happens, the party will not have to pay filing fees and may have other court costs waived as well.
